Personal Injury Claims - Cyclist
injured in road accident awarded £5
million.

Richard Harrison was riding his
bicycle when he was hit by a car, near his home in Hexham, Northumberland,
in May 1999. He suffered horrific head injuries when he was knocked off his bike. He
was awarded £5 million in a successful personal injury claim.
Before the accident, Harrison had a
successful career with Analytical Environmental
Services. The accident left him with severe brain damage, paralysis in his legs and arms, and
speech problems.
A report in cyclingnews.com had said that
the third party insurers had
initially claimed "contributory negligence" against
Harrison because he was not
wearing a helmet at the time of the crash.
The insurance company later withdrew
this claim and agreed to an out-of-court settlement
of £5 million in compensation. Harrison's
personal
injury solicitors have stated that
insurers were trying to use helmets as an excuse to reduce damages to cyclists.
According to cyclingnews.com, this is
the third personal injury claims case
where insurers have used the negligence argument
- and the third time that the argument has been dropped and the case settled out of court.
The compensation is calculated to meet the cost of
Harrison's ongoing medical and therapeutic care and could reach up to £5m or more.
An Interim
Payment of £450,000 was made in 2002.
The latest will see a one-off payment of £1.3m and then annual payments of £180,000 for
the rest of Harrison's life.
