Anoff v
Merton, Sutton and Wandsworth Health Authority
High Court
Monday 30 June 2003
Cerebral palsy victim Stephen Anoff, now aged 13, of Putney, was starved of oxygen during his delivery at St George's Hospital, Tooting,
in October 1989. Lawyers
successfully argued that there had been a negligent delay in his delivery following an abnormal CTG trace.
The hospital's managers - the Merton, Sutton and Wandsworth Health Authority - admitted liability.
The settlement approved by the High Court today means
Anoff could eventually receive more
than £4 million - a £900,000 lump sum payment, along with £77,000 per year until he is 25 and £132,000 every year thereafter.
Anoff's
brain injuries had been caused by ‘negligence and breach of duty by the hospital in the course of management of his mother's labour’.
The health authority had admitted breach of duty
and accepted it had ‘failed to deliver him at an earlier time and, had he been delivered earlier, he would have been
unscathed’.
