Road Accident Girl confined to wheelchair wins £5.1m damages 

 



A young girl left wheelchair-bound after a road accident has been awarded £5.1 million in damages. Tania Chapman-Fortune, from Sussex was three years old when, as a back seat passenger in a car driven by her nanny, she suffered devastating injuries in a head-on collision  She was sitting on a child's booster seat and strapped in by the car's seat belt. The accident happened on the A22 Uckfield bypass, Uckfield, Sussex on November 5, 1994.

The Court heard that Tania, now 12, described as a bright and intelligent child, requires 24-hour care. She suffered severe personal injuries and lost the use of her legs and much of the use of her arms. She now needs extensive therapy and equipment to help her to do even the simplest tasks. 

 
After hearing details of the case against nanny Carrie Elphick, who was also seriously injured in the crash, Mr Justice Owen said he was satisfied that the £5.1 million sum, which will be paid by insurers, was an "entirely fair and appropriate settlement". He added, "This is a very tragic case, but what is perhaps most important for Tania and for her mother is that her future is entirely secure." The judge heard that liability was never an issue - the only matter that had to be decided was the level of compensation to be paid.

Whilst no amount of money could ever begin to compensate for injuries sustained in an accident, the award is meant  to provide financial security and care for the victim.
