What
can I claim for?
A successful
accident claim should provide you with a lump sum of money, to compensate for the damages you
sustained as a result of the
accident. The aim is to put the innocent party as far as possible in the financial position he would have been in
if the accident has not occurred.
Compensation that can be claimed includes items of ‘General Damages’ which
include ‘pain and suffering’ for both the initial injury and for any ongoing suffering or disability, ‘loss of amenity’ which is loss of the enjoyment of life and for any ‘disadvantage on the labour market’ caused by permanent injury. Future losses are also included in accident claims and a special calculation is applied to the estimated annual loss to arrive at a fair figure for compensation.
